Terms and Conditions
1. Definitions
1.1 “Company” refers to Nection Ltd, trading as rntl.nz.
1.2 “Client” refers to any individual, business, or organization engaging the Company for website development services.
1.3 “Services” refers to the website development and related services provided by the Company.
1.4 “Agreement” refers to the terms and conditions outlined herein, which govern the relationship between the Company and the Client.
1.5 “Company website” refers to the website at www.rntl.nz.
2. Acceptance of Terms
2.1 By engaging the Company for Services, the Client agrees to be bound by these Terms and Conditions.
Changes to Terms and Conditions
3.1 The Company reserves the right to amend these Terms and Conditions at any time without prior notice. The updated Terms and Conditions will be made available on the Company’s website and will take effect immediately upon posting.
3. Services Provided
3.1 The Company specialises in building and hosting websites for clients who own short-term rental accommodations.
3.2 Specific deliverables and timelines will be agreed upon between the Client and the Company prior to project commencement.
4. Payment Terms
4.1 A non-refundable deposit of 50% of the total project cost is required before the commencement of any work.
4.2 The remaining 50% balance is payable upon completion of the project, prior to the handover of the final website.
4.3 The Company reserves the right to withhold delivery of the final website until full payment has been received.
4.4 Website hosting and related services are subject to a monthly fee. To keep a Client’s website active and accessible, timely payment of the hosting fee is required each month. If the monthly fee is not paid, the Client website will become unavailable until payment is received.
4.5 There is no minimum contract for payment of website hosting services.
4.6 Payments can be made via the methods specified on the Company’s invoice.
5. Client Responsibilities
5.1 The Client must provide all necessary content, images, branding, and other materials required for the completion of the website in a timely manner.
5.2 The Client is responsible for reviewing and approving all work submitted by the Company during the project timeline.
6. Intellectual Property
6.1 Upon full payment of the project cost, ownership of the completed website and its associated content will be transferred to the Client.
6.2 The Company retains the right to showcase the completed website in its portfolio unless otherwise agreed upon in writing.
6.3 All software licences provided for the use of Clients remains the property of Nection Ltd.
7. Cancellations and Refunds
7.1 If the Client wishes to cancel the project for any reason after paying the deposit, the deposit will not be refunded.
7.2 If the Company is unable to complete the project due to unforeseen circumstances affecting its ability to deliver the project, the Client will be refunded any payments made, including the initial deposit.
8. Limitation of Liability
8.1 The Company will not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use the completed website.
8.2 The Company’s total liability under this Agreement shall not exceed the amount paid by the Client for the Services.
9. Amendments and Revisions
9.1 The Client is entitled to a limited number of revisions as outlined in the project scope.
9.2 The advertised fee covers only the standard website as defined in the scope of work. Any additional work outside this scope, including but not limited to:
- Custom design features or complex functionality (e.g., e-commerce, membership systems, booking systems, etc.).
- Integration of third-party platforms or APIs not specified in the original agreement.
- Modifications, updates, or additions to content after the project is completed.
- Ongoing maintenance and support beyond the initial delivery phase.
will be subject to an additional charge at the Company’s standard rate of $90 per hour + GST.
9.3 The Company will provide the Client with an estimate of the additional time and cost for any requested changes before proceeding. The Client must approve these additional charges in writing prior to the commencement of any extra work.
10. Confidentiality
10.1 Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the project.
11. Termination
11.1 The Company reserves the right to terminate the Agreement if the Client fails to comply with these Terms and Conditions or delays the project excessively.
12. Governing Law
12.1 This Agreement shall be governed by and construed in accordance with the laws of New Zealand.
13. Entire Agreement
13.1 These Terms and Conditions constitute the entire Agreement between the Company and the Client and supersede any prior agreements or understandings.
